More on Fifth Circuit appeal of Katrina Canal Breaches cases

Here’s a follow-up story from Mike Kunzelman of the Associated Press about yesterday’s hearing at the Fifth Circuit on the appeal of federal judge Duval’s opinion in the Canal Breaches cases. The story says Fifth Circuit judge Carolyn King promised the appeal would be decided as quickly as possible and would not just go to the back of the line.  One word of caution: "quick" in appeals court language is even more of a relative term than it is in common parlance. I don’t know the schedules in the Fifth Circuit, but in the Ninth Circuit where I practice, getting a decision in less than 18 months to two years from the date of the notice of appeal is considered faster than normal.
